FAQS

Compliance & Tax-Credit
Answers

Everything you need to know about ADA website compliance, WCAG 2.1 AA, and how the IRS Section 44 credit works. Still have questions? We'd love to hear them.

? What does ADA compliance actually mean for a website?
Courts have ruled that the Americans with Disabilities Act covers websites — meaning your site has to work for people with disabilities (screen-reader users, keyboard-only users, people with low vision, etc.). The legal benchmark courts reference is WCAG 2.1 AA. We deliver every project to that standard.
? Could my business really get sued over my website?
Yes. There were over 4,000 ADA website lawsuits filed in 2025 — up 37% year over year. That's about 11 new lawsuits every single day. Settlements typically run $15,000–$110,000, and lawyers actively scan small-business sites looking for violations.
? How does the IRS Section 44 tax credit work?
It's a federal credit covering 50% of qualifying accessibility spending between $250 and $10,250, capped at $5,000 per year. You claim it with IRS Form 8826. Qualification typically requires under $1M in prior-year revenue or 30 or fewer full-time employees. We provide the paperwork — your CPA confirms eligibility and files the credit. We do not provide tax advice.
? Will I actually get the full $5,000 back?
It depends on your total qualifying expenses across your business and your tax liability — which is why we never guarantee a specific amount. Our partner CPA (included with Full + CPA and Maximum + CPA) audits your business to maximize what you can claim. Your own accountant confirms and files. Most clients see a meaningful offset against the invoice.
? How long does the work take?
Essential delivers in about 7 days. Full + CPA and Maximum + CPA typically deliver in 14 days. Maximum + CPA then continues with 12 months of monitoring and unlimited fixes. We confirm timelines in writing before you sign anything.
? Do those accessibility overlay widgets work?
No. 32% of 2025 ADA lawsuits hit sites that already had overlay widgets installed. Lawyers know widgets don't fix the underlying code, and courts have repeatedly sided with plaintiffs whose only "accessibility" was a widget. We fix the code itself.
? What if I receive a demand letter?
If your site is already certified by us, you have the documentation your lawyer needs to respond: audit history, WCAG 2.1 AA certificate, remediation log, and CPA expense record. The Maximum + CPA package also includes a demand-letter response template and full legal documentation folder for fastest possible response.
